Victim in September shooting pleads not guilty to assault

As Scott Hayes of Framingham awaits trial for allegedly shooting a Newton man during a pro-Israel rally, the man he shot appeared in court Monday to answer for charges of his own.

Caleb Gannon, 32, pleaded not guilty to a charge of assault and battery in Newton District Court Monday morning. He was released on personal recognizance and ordered to stay away from Hayes, WCVB reported.

Gannon is due back in court Feb. 3.

Police say on Sept. 12, Gannon was walking in Newtonville when he started yelling at a small group of pro-Israel protesters. Videos taken at the scene show Gannon run over to Hayes, who was one of the protesters, and struggle on the ground with him before a gunshot is heard.

Hayes was charged with assault with a dangerous weapon. Gannon was later charged with assault and battery.

Social media posts before the Sept. 12 incident show Gannon upset with the Israeli military operation in Gaza and calling for the downfall of the United States. Hayes’s social media posts showed aggression toward Palestinian supporters and, in one X post, Hayes showed a photo of a gun.
