The Ruderman Family Foundation (RFF) of Newton has dropped its lawsuit against Jubilaria Media, a Colorado-based media production firm.
RFF had sued Jubilaria Media last fall over claims of anti-Semitism. The company chose not to produce podcasts for RFF due to disagreements over views on Palestine, which RFF felt was discriminatory. RFF promotes mental health awareness as well as the “strategic importance of the relationship between Israel and the American Jewish Community.”
In the letter submitted to the courts requesting a voluntary dismissal of the case, RFF’s lawyer wrote that “Plaintiff believes serious issues of discrimination and bias are raised by its Complaint, but it has decided that addressing those issues is better accomplished by deploying resources in the community, rather than through litigation.”
Jubilaria Media filed its own request for the case to be dismissed in December. They wrote that “the facts alleged fail to support the claims asserted.” But they also included another item that meant RFF did not have much to go on (regardless of whether or not there was discrimination): the contract that Jubilaria Media and RFF signed had an indemnity clause. It read, “The Client agrees to indemnify and hold harmless Agency of and from any and all claims, demands, losses, causes of action, damage, lawsuits, judgments, including attorneys’ fees and costs, to the extent caused by or arising out of or relating to the work of the Agency.”
Additionally, this contract was only for the first test episode (which Jubilaria Media did produce); the firm had not signed an additional contract to produce more episodes.
